The Department of Town and Country Planning (DTCP) has suspended the licence of a residential group housing project in Sector 53, Golf Course Road, being jointly developed by Tulip Infratech and Vipul Ltd. The suspension follows allegations that the developers changed building plans without obtaining proper approval from allottees and without informing them.
The original licence for the 19-acre project was granted to Vipul Ltd in 2004 under Section 3(3A) of the Haryana Urban Area Development Act 1975. The Senior Town Planner issued suspension orders on May 9, and the Deputy Commissioner had separately directed authorities on May 6 to stop any creation of third-party rights on the land.
What the complainant alleges
A complainant named Akhil Surekha has alleged that despite active suspension orders from both DTCP and the district administration, construction continued and third-party rights were being created. He further alleged that crores were collected from buyers during the suspension period while keeping them uninformed. On the question of building plan changes, his allegation is that NOCs were obtained from some allottees through a process that kept them unaware of the actual nature and scale of the changes being approved.
What the developers say
Tulip Infratech has refuted the allegations, stating that NOCs were duly obtained from allottees and that the matter is currently sub judice. The company has appealed to the DTCP Director to review and restore the licence. Vipul Ltd has similarly indicated it will contest the order, maintaining that no violations occurred.
The District Town Planner (Enforcement) confirmed that construction at the site has been stopped twice and stated that any fresh resumption of work would trigger a reference to the town planning headquarters for further action under applicable rules.
